Dowry is any  property  or  valuable security given or agreed to be given either directly or indirectly-

(a) by one party to a marriage to the other party to the marriage; or

(b) by the parents of either party to a marriage or by any other person, to either party to the marriage or to any other person;

at or before or any time after the marriage in connection with the marriage of said parties.

Asking for or taking dowry

in India

Anyone giving, taking or abetting the act of giving or taking of dowry, he shall be punishable with imprisonment for a term which shall not be less than five years, and with the fine which shall not be less than fifteen thousand rupees or the amount of the value of such dowry, whichever is more.

The courts can award less than six months' imprisonment to anyone convicted for asking for or taking dowry provided there exist special circumstances and the court makes a note of such special circumstance.

The law in India had to be amended to suitably and effectively deal with not only with cases of Dowry Death but also cruelty to married woman by their in laws. Legal experts felt that willful conduct of the husband or any other relative of the husband as is likely to drive the woman to commit suicide or cause grave  physical or mental injury to her, and harassment of woman by her husband or by any relative of her husband with a view to coercing her or any of her relatives to meet any unlawful demand for property should be punishable as cruelty, ...the offence as cognizable...

Who is an NRI?

If you are an Indian but now resident of another country or territory and not usually domiciled in India although holding an Indian passport, you are deemed to be an NRI for all legal purposes in India.

If in any tax year you have lived in India for more that 182 days, then for all purposes you can claim to be an Indian and not an NRI. Conversely, if you have traveled to India multiple times but your total stay in India – adding up all the visits in that year does not add up more than 182 days, you are deemed NRI.

There are some special rules which may become applicable if you are an NRI be it tax concessions or tax payable in India on assets appreciating  in a tax year in India. 

Proclaimed Offenders

Before they know it, the police cases against them get registered – and unattended – because they have left India – keep proceeding. Ultimately – they are declared POs or Proclaimed Offenders and Absconders running the risk of being arrested next time they travel to India.
